BLUE NAUTILUS YACHT CONCIERGE / G.D. NAUTIC, LLC

BLUE NAUTILUS YACHT CONCIERGE, G.D. NAUTIC, LLC (referred to as "We," "Us," or "Our") acts as an agent and service provider in arranging various yacht-related and luxury lifestyle services for its clients ("the Client" or "you").

By confirming a booking or remitting payment for our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Nature of Services

1.1. Role of the Company: The Company provides concierge, maintenance, detailing services, provisioning, transportation, booking, and itinerary planning services with reasonable skill and care. We research, book, and coordinate services on your behalf based on your specific requests and requirements.

1.2. Company Disclaimer: When we book third-party services, we act as an agent for you. The resulting contract for those services is between you and the third-party supplier (the "Supplier").

1.3. Supplier Terms: All services provided by Suppliers are subject to their own terms and conditions, cancellation policies, and local laws/regulations. You are responsible for reviewing and understanding those separate terms.

1.4. No Liability for Supplier Actions: The Company disclaims all liability for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from their services.

2. Payment

2.1. Confirmation and Payment Schedule:

  • Deposit (typically 50% of the estimated total cost) is required to confirm the service and for the Company to begin formal arrangements.

  • Full payment is required at the end of each week, biweekly, month depending on contract arrangement.

2.2. Incidentals: A credit card must be kept on file for incidentals and any post-service charges not covered by the APA or initial payments. Advance Provisioning Allowance (APA).

2.3. Price Changes: Prices quoted are based on current rates and availability. The Company reserves the right to pass on any increases in Supplier costs, taxes, or fuel surcharges at any time prior. .

3. Cancellations and Modifications

3.1. Cancellation by Supplier/Force Majeure: The Company is not responsible for cancellations due to events outside its reasonable control or that of the Suppliers (e.g., adverse weather, natural disasters, epidemics, government actions, mechanical failure, or war). In such cases, the Company will use reasonable efforts to secure refunds according to the Supplier's terms or find comparable alternative arrangements. The Company's liability is limited to the fees earned for arranging the booking.

3.2. Itinerary Changes: Itineraries are suggestions and are subject to change due to weather conditions or the Captain's discretion (if applicable) for safety reasons. No refunds will be issued for such changes.

4. Limitations of Liability and Indemnification

4.1. Indemnification:

Customer agrees that Blue Nautilus Yacht Concierge - G.D. Nautic LLC shall not be liable for any incidental, special, or consequential damages, including but not limited to loss of use of Vessel, lost revenues, or lost profits, whether due to alleged breach of this Agreement, negligence, or any other basis

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, and agents from any and all claims, liabilities, damages, and expenses (including legal fees) arising out of or in any way connected with your breach of these Terms, your use of the services, or your negligence or willful misconduct.

4.2 Insurance Requirements:

Mandates that the yacht owner maintain full hazard and liability insurance (e.g., Marine Hull Insurance and Marine P&I) and often requires a waiver of subrogation against the service provider

5. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of [SaintPetersburg Jurisdiction, State of Florida, USA]. Any dispute arising out of or in connection with these terms shall be subject to arbitration in [SaintPetersburg Jurisdiction, State of Florida, USA] or the exclusive jurisdiction of the courts of [SaintPetersburg Jurisdiction, State of Florida, USA].
